The auction will run from October 9, 2008 to October 21, 2008, with proceeds going to Empire State Pride Agenda Foundation in order to support our work winning equality and justice for lesbian, gay, bisexual and transgender New Yorkers.
Auction items range from a sitting with renowned photographer Richard Phibbs to a four night stay in a beautiful Buenos Aires loft.

Terms and Conditions
The items listed on this website are offered and sold by the Empire State Pride Agenda Foundation (“The Foundation”). By bidding on these items, individuals agree to and are bound by the following terms and conditions. Any questions should be directed to the Foundation on the following terms and conditions, as amended by any posted notices or oral announcements during the sale of all of the property listed herein.
1. The Foundation does not assume any liability or responsibility for the authenticity of the authorship of any property offered at this auction (that is, the identity of the creator, source or origin, as the case may be, with which the creation of any property is identified.)
2. All property and/or vacation packages for auction are sold “as is” and the Foundation does not make any representations or warranties of any kind or nature, expressed or implied, with respect to the property and/or vacation packages and in no event shall be responsible for the correctness of any descriptions of the property and/or vacation packages. No statement in the catalogue or made at the sale or in any bill of sale or invoice or elsewhere shall be deemed such a representation or warranty or any assumption of liability. The Foundation makes no representation or warranty, expressed or implied, as to whether the purchaser acquires any reproduction rights in the property before bidding to determine its condition, size and whether or not it has been repaired or restored.
3. Any property or vacation package may be withdrawn by the Foundation at any time before the actual sale.
4. The Foundation reserves the right to reject a bid from any bidder. The highest bidder shall be the purchaser. In the event of any dispute between bidders, the Foundation shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any disputes arise after the sale, the Foundation’s sales records shall be conclusive in all respects.
5. If the Foundation determines that any opening bid is not commensurate with the value of the article offered, they may reject the same and withdraw the article from sale, and if, having acknowledged an opening bid, the Foundation decides that any advance thereafter is insufficient, it may reject the advance.
6. At the close of the online auction, the highest bidder shall be deemed to have purchased the offered lot subject to all of the conditions set forth herein and thereupon (A) assumes the risk and responsibility thereof (B) will sign a confirmation purchase thereof and (C) will pay the full purchaser price therefor. If the foregoing conditions and other applicable conditions are not complied with, in addition to the other remedies available to the Foundation by law, including, without limitation, the right to hold the purchaser liable for the bid price, the Foundation at their option may either (A) cancel the sale, or (B) resell the property on three days notice to the purchaser and for the account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for payment of any deficiency, all other charges due hereunder and incidental damages.
7. Pursuant to section 116(A) of the New York State Tax Law, no New York State or local sales tax is required on the purchase of lots offered for sale by the Foundation. All checks should be made payable to the Empire State Pride Agenda Foundation. The purchase price over the fair market value of the property purchased is a tax-deductible contribution to the Foundation.
