1. The set visit is limited to the Recipient and the Guest for one day on the set. The set visit, once won, is non-transferable, cannot be sold, and is non-assignable.

2. The Recipient and the Guest must be at least ten (10) years of age.

3. The actual episode will be scheduled in accordance with the production needs of the series. All aspects of the set visit, including without limitation, the length, duration and area(s) visited during the set visit, will be determined by DATG in its sole discretion.

4. Transportation, incidentals and lodging will NOT be provided. Travel to and from the production location, as well as accommodations and meals at said location, will be the Recipient’s and the Guest’s sole responsibility.

5. Cameras are not allowed on set.

6. DATG does not represent or warrant that the Recipient and/or the Guest will be able to meet the contestants or Celebrities of “American Idol.”

7. The Recipient and the Guest must fully follow and comply with DATG’s instructions, rules and regulations (including signing the release attached hereto as Exhibit A and Exhibit B) and at all times will be subject to removal from the sets of DATG for failure to follow and comply with such instructions at all times that the Recipient and the Guest are permitted on the set by DATG.

8. The Organization will be solely responsible for the furnishing of any additional items that the Organization includes in its promotion and administration of the auction.

9. It is expressly understood and agreed that (a) all of DATG’s obligations and agreements will be subject to DATG’s right to substitute alternate date(s) and/or an equivalent prize item, as determined by DATG in its sole discretion; and (b) in the event the series “Dancing With The Stars” ceases to be in production or the applicable network no longer broadcasts the series “American Idol,” DATG will have no obligation to the Organization or to the Recipient.

10. The Recipient and the Guest represent and warrant that neither the Recipient, the Guest, nor their representatives will issue or permit the issuance of any publicity, grant any interview or make any statement concerning DATG or “American Idol” without DATG’s prior written consent and the Recipient and the Guest agree to keep the provisions of these Stipulations and DATG’s business and creative practices and materials confidential.
