General Conditions:

By purchasing this award prize, the recipient agrees to abide by the terms of these official rules, which are final on all matters pertaining to this prize/award.  All federal, state, and local laws and regulations, where appropriate, apply.  All taxes (including, without limitation, federal, state, and local taxes) on or connected with prizes are the sole and exclusive responsibility of the respective winner/recipient Recipients further agree to abide by the policies and rules of the practice of Shirley Madhere, M.D., P.C.

By participating in and accepting this prize/award, the recipient agrees to release and hold harmless Shirley Madhere, M.D., P.C., its respective agents, and advisors and employees, officers, directors, agents, contractees, representatives of sponsors, and associates from and against any and all losses, damages, rights, claims and actions of any kind arising in connection with the auction, charity, benefit or organization or resulting from acceptance, possession, or use or misuse of any prize awarded in connection with the auction/prize, including without limitation personal injury, death, deformity or disfigurement, and/or property damage as well as claims based on publicity right, defamation, or invasion of privacy as delineated by HIPPA law.

The winner/recipient is required to verify and present proper and legal picture identification within 30(thirty) days of notification of winning/purchasing the prize. The winner/recipient may forfeit the prize in its entirety if verification cannot or has not been made within 30(thirty) days. Upon proper verification, claiming of the prize must be made within one year of the date of notification or awarded, specifically, within a time not to extend beyond 01 March 2010.

The winner must supply Shirley Madhere, M.D., P.C., with his/her legal name, mailing address, date of birth, daytime and nighttime contact numbers, and e-mail address. The winner may not request substitutions of prize winnings, which qualify the recipient to receive an initial consultation with plastic surgeon. Dr. Shirley Madhere. The winner is solely responsible, therefore, for any and all fees and taxes, and all such additional costs that may be incurred as a result of additional services or procedures or time extended beyond the provisions of the current award/prize. If the specified prize becomes unavailable due to unforeseen circumstances, Shirley Madhere, M.D., P.C., may substitute a prize/award of similar or equal value, at its discretion and without advance notification to the winner/recipient

No Warranties:

Shirley Madhère, M.D., P.C., expressly disclaims all warranties, whether directly expressed or implied, covering any aspect of the prize/award furnished as part of this auction/function/event, including, without limitation, implied warranties of merchantability or fitness for a particular purpose.

Moreover, Shirley Madhère, M.D., P.C. and its agents, employees, associates, and affiliates reserve the right to deny claim of this prize/award if the circumstances or the recipient is deemed unsuitable, inappropriate, or unfit to claim this prize/award. Furthermore, the recipient agrees, without coercion, to the following, conducted by Dr. Shirley Madhere:

(a) To be seen in initial consultation for evaluation of any prospective, if any, procedure;

(b) To undergo a thorough medical evaluation to determine eligibility for any prospective, if any, procedure, treatment or elective therapy;

(c) To acknowledge and accept the right of Dr. Shirley Madhère to decide whether the prize/award recipient is suitable to receive or undergo any particular procedure before he or she is actually awarded a procedure;

(d) To acknowledge and accept Dr. Shirley Madhère's freedom to refuse to perform the initial consultation or procedure at anytime if she does not believe the winner is a suitable candidate for either the consultation or procedure;

(e) To acknowledge, as the recipient the opportunity to refuse to receive any procedure if he or she is not comfortable with Dr. Shirley Madhère performing the procedure; and

(f) To agree not to expose Shirley Madhère, M.D., P.C. or its agents, associates, affiliates, or employees to financial recourse if the award/prize recipient is denied a consultation or procedure for any reason.

Governing Law:

This auction/prize/award/event and the rights and obligations of Shirley Madhère, M.D., P.C. and participants will be governed and controlled by the laws of New York State, applicable to contracts made and performed therein without reference to the applicable choice of law provisions, as well as applicable state and federal law.
