GENERAL INFORMATION AND TERMS OF SALE

All bids are considered a binding commitment to purchase.

All property is sold 'as is'. All sales are final. Property is open to thorough inspection, and it is the bidder's responsibility to determine condition.

Though all description and commentary are believed to be correct, neither the auctioneer nor the artists makes any warranties or representations of any kind with respect to the property, and in no event shall be held responsible for having made or implied any warranty of description genuineness, authorship, period, attribution, provenance, culture, source, origin, condition.

A bid by any person shall be conclusive proof that the person has made himself acquainted with these conditions of sale and has agreed to be bound by them.

The buyer shall be the highest bidder, should a tie or dispute arise between two bidders, the auctioneer may, at his discretion, reopen the bidding between the high bidders until the property is sold. To maintain the continuity of the sale, it shall be the duty of the auctioneer to advance the bidding at his own discretion, and may reject nominal or fractional advance should it, in his estimation, prove injurious to the sale.

Payment may be made in cash, check or credit card. Checks should be made payable to Peck Slip School PTA.

Payment in full for all items and services must be made for all auction items at closing time March 28, 2015.

In the event the purchaser fails to comply with the terms of final payment and removal as required; the auctioneer reserves the right to resell the items concerned.

The auctioneer is not bound by any actions or statements made by any person other than himself. All statements made by the auctioneer the day of the auction take precedence over printed materials.

The auctioneer reserves the right to withdraw or add any property any time before or during the sale. Auctioneer reserves the right to reject the bid or bids not commensurate with the value of the item offered and remove the item from the sale.

All property sold may be the subject to an undisclosed minimum reserve bid. If the reserve price is not achieved, the property may be withdrawn from the sale.

Any and all of these conditions may be waived or modified at the sole discretion of the auctioneer.

All sales are final. All items have been donated to PS 343/Peck Slip School PTA and are sold by it, not the donor. Please do not request refunds or exchanges from donors. 

No liability is accepted for claims resulting from the utilization of property or services sold.

At exactly 9:45pm on March 28, 2015, title of the item passes to the highest bidder who assumes full risks and responsibility.

All items on display must be taken home that evening.

Payment and pick-up time will begin at the close of the auction.
